Stage 3 - Outcome and future review

Understand your medical review outcome and find out what to do next.

Your medical review outcome is based on the medical reports you provided, and the medical review driving test or occupational therapy driving assessment.

We assess your fitness to drive using AustRoads’ national Assessing Fitness to Drive Standards.

What happens if you pass the medical review?

If the medical review assessment shows that you’re fit to drive, there are three common outcomes:

  • You’ll be able to keep your driver licence and continue driving.
  • You’ll be able to keep your driver licence and continue driving, but you will need to be assessed again in the future.
  • You’ll be able to keep your driver licence and continue driving, but only under certain conditions.

Conditions may include wearing glasses, driving automatic car or driving in daylight hours or only in familiar surroundings (e.g. local area restriction). 

What happens if I fail the medical review?

If the medical review assessment shows you do not meet the national medical standards, unfortunately you won’t be able to continue driving and your licence will be suspended or cancelled. 

If your licence is suspended or cancelled, you can apply to get it back if your medical condition improves. We’ll provide you with information about this process when your licence is suspended or cancelled.

Can you appeal the decision?

If we vary, suspend or cancel your licence you can appeal our decision. There are two ways to do this:

  • Write to VicRoads and ask for an internal review
  • Appeal to the Magistrates Court.

Ask for an internal review

After being notified of a decision to vary, suspend or cancel your licence, you have 28 days to write and ask for an internal review. VicRoads will conduct an independent review and either confirm or change the decision.

Appeal to the Magistrates Court

After being notified of the decision, you have 28 days to appeal to the Magistrates Court. 

To lodge an appeal you must give:

  • written notice of appeal to the clerk of a Magistrates' Court. The Clerk of Courts will arrange for a date for the appeal to be heard and give you an endorsed Notice of Appeal.
  • VicRoads a copy of the endorsed Notice of Appeal at least 14 days prior to the date the appeal is to be heard.

If the appeal is successful the driver licence will be reinstated when the court order is presented to VicRoads.
